Blacklist: 105 foreign ships that entered Crimea over period of annexation (Russian and Ukrainian not included)

The monitoring group of the Maidan of Foreign Affairs and BSNews continues to publish the lists of vessels that after the occupation and annexation of the Crimea by the Russian Federation, have called at the nine ports of the Crimean peninsula in Yevpatoriya, Sevastopol (2 ports), Yalta, Feodosia and Kerch (4 ports).
We’d like to note that our first publication on the subject was dated May 25, 2014 while the first consolidated "black list" was published on July 7, 2014.
Today we present to our readers the "black list" of vessels that belong to ship owners outside of Russia and Ukraine for the period from the beginning of the annexation, that is March 18, 2014, to July 10, 2015. The list includes 105 ships.
An Explanatory Preamble
Why aren’t the RF ships in the list?
The reason is that compiling a list of more than 100 vessels from the Russian Federation requires no less effort that the one presented below, during which time the latter would have been out of date. The list of the RF ships will be, however, published in a few days.
Why aren’t any Ukrainian ships in the list?
Because some Ukrainian entrepreneurs who better than others understand the gravity of the violations, have been very resourceful in concealing their schemes. So, each such instance that raised our suspicion, requires a thorough media investigation. The list of the Ukrainian offenders will be published in a few days.
Who, besides the general audience, are these lists for?
This product of the monitoring group of the Maidan of Foreign Affairs and the BSNews has a long-time professional audience.
It includes the “marine” and other media and news agencies, shipowners, charterers and ship operators, maritime brokers, crewing companies, offshore insurance companies, port authorities, flag administrations, maritime labor unions, seafarers and so on, as well as the embassies, ministries and other state bodies of different countries and certainly, Ukraine.
What happens after the publication of the "black list"? What is their effectiveness?
No matter what the skeptics say, the publications work and very effectively. As a result of our publications and their reprints by our colleagues in various media throughout the world:
- Shipowners, charterers, ship operators and marine brokers refuse to sign contracts and meet freight requests for ships planning to call at the Crimean ports which they specifically state it in their contracts;
- crewing companies refuse to recruit crews for the ships planning to make calls at the Crimean ports;
- marine insurance companies refuse to insure the vessels headed for the Crimean ports;
- port authorities pay more attention to checking the logbooks while flag Administration send out warning letters to the shipowners whose vessels are registered under the respective flags;
- maritime unions warn their members about the possible consequences of hiring the ships that plan calls the Crimea and refuse to hire sailors on ships that will be used there.
The state authorities of the countries in the list, especially those who on March 27, 2014 voted at the United Nations for the non-recognition of the Crimean annexation, including their embassies and ministries, after our publications, their reprints in media and the appropriate letters of the Maidan of Foreign Affairs, check the facts and often do not recommend or even prohibit shipowners from entering the Crimean ports.
At the same time, the Ukrainian authorities, including law enforcement, consider our publications not only as information media reports, but as documented facts of committed crimes or suspicions thereof.
Recently, several dozen criminal cases on specific ship entries have been launched. Three vessels have been arrested in Ukrainian ports, while two more have been detained. Currently, this difficult and time-consuming work continues.
On July 2, 2015, new Greek high-capacity ferry Maria Eleni (Maria) started servicing the line Port-Kavkaz – Kerch Fishing Port (cargo transport, incl. carrying hazardous materials).
When reading the list, it’s important to bear in mind:
1. Monitoring of the vessel calls the annexed Crimea is conducted daily, including weekends and holidays.
Each ship falls into the "black list" only on the basis of the facts recorded by the monitoring group and then carefully cross-checked from various sources. It is a great help us to have volunteers from different countries, predominantly marine specialists – from dockworkers, marine agents and brokers to experts in the maritime law.
The fact that the MFA and BSNews monitoring group has included these ships and shipowners in the "black list" of violators of the legal regime of the temporarily occupied territory of Ukraine means that we will then conduct daily enhanced monitoring in respect to each such vessel and take actions along the administrative, diplomatic, maritime and legal channels.
2. The primary source of data is the global computer software systems and the AIS (automatic identification system) display signals of each vessel.
Every few minutes, the AIS automatically broadcasts in the VHF range the vessel’s name, port of destination, location, speed and dimensions, as well as its unique IMO code assigned to each vessel from the moment of its inception to its write-off, regardless of the future renaming or reflagging. These signals are received by the shore stations.
Use of the AIS (in accordance with the Convention SOLAS 74/88) is mandatory for vessels of over 300 gross tons engaged in international voyages, vessels of over 500 gross tons not engaged in international voyages and all passenger vessels.
The International Convention for the Safety of Life at Sea (SOLAS) is the most important of all the international agreements on the safety of the merchant ships. Each vessel within the scope of that document is to fulfill its requirements. Otherwise, it may be detained.
Turning off the AIS entails serious consequences, including the possible revocation of the vessel captain’s and navigator’s licenses. Nevertheless, the ships calling at Crimea often do turn off the AIS for a while to conceal their location at a Crimean port. However, over the past 15 months, we have developed a technology of how to deal with it in many cases.
It should be mentioned, however, that the passage of radio waves in the UHF range and the AIS signal reception (and hence the completeness of the data) depends on the many factors such as, the weather, terrain, the power of the AIS signal transmitters and receivers and the number of the coastal receiving stations in the specific region. We are talking not just about the Crimea since the AIS signal from the vessels near the Crimean coast is received by most of the receiving station located in different countries of the Black Sea.
Therefore, in spite of all our experience and applied methods, figuring out the ship’s route could still have a small margin of error.
We also take into consideration that in the event of a storm warning or a real storm in the Black Sea, ships, especially the older ones, often "press themselves" to the Crimean coast of Crimea, thus, entering the territorial waters of Ukraine and remain anchored there for several days. That is not a violation. But in such cases we have to enhance the monitoring of the vessel in order to understand its real intentions.
3. The vessel is included in the list if it has called at a port in the occupied and annexed Crimea after March 27, 2014.
On March 27, 2014 in a resolution adopted by a vote of 100 countries, the UN General Assembly called upon all states, international organizations and specialized agencies not to recognize any change to the status of the Autonomous Republic of Crimea and Sevastopol and to refrain from any actions or steps that could be interpreted as the recognition of any such change of status.
Just a reminder: the International Maritime Organization (IMO) that regulates the main issues of the world shipping is a specialized agency of the United Nations.
In addition, on April 27, 2014, the Law of Ukraine on the legal regime of the occupied territories of the Autonomous Republic of Crimea and Sevastopol that introduced criminal liability for the illegal crossing of the borders of Ukraine in the occupied peninsula came into force. The penalty may include confiscation of the vehicle.
Thus, upon the request of Ukraine, the crews and ships that have called at the Crimean ports after this date will have the prospect of criminal liability and other sanctions, including, in the foreign ports.
4. The order of the "black list" is based on the country of the shipowner, since in the maritime community the vessel is referred to as "Turkish", "Greek" or "Italian" according to his nationality and not the vessel’s flag.
Naturally, in many cases, the owner himself does not serve as the vessel’s operator, but instead passes it to the control of the operators as charter, freight, etc. There are several types of charter: voyage charter is the contract for chartering a marine vessel for a fixed number of flights; bareboat charter - a lease without crew with the change of the name and even the flag’s statehood is allowed and time-charter - charter contract of a marine vessel for a certain period of time.
Thus, uncovering the operator’s firm and the conditions of the charter is an extremely difficult and time-consuming task, all the more so in regard to the Crimean situation, since as a result of our work and the international sanctions, charter contracts for only 1-2 flights become more and more common.
However, the possible justification for shipowners that they allegedly cannot affect the charterers is naive as the unacceptability of calls at the occupied Crimea should be specified in the contracts.
5. The vessel that violated the regime of the occupied territory that has Greek, Turkish or other owner, remains on the list under the same time country where he was enabled us for the first violation (with further adjustments in a particular column of the table).
This is due to the fact that some companies who have felt the results of our monitoring and the sanctions of the EU other countries of the civilized world, especially Greek and Turkish, even back in the 2014 began to re-register their vessels in the names of the fictitious owners, change the flag – often to that of some exotic island in the Pacific - and the name. As always, we would be grateful if volunteers assist us in clarifying these situations.
However, if you note any errors or inaccuracies, please, let us know and we will fix those. There have already been several such cases in our practice and we were very pleased to restore justice.

The current info on each vessel’s calls at the Crimean ports can be seen by clicking on the ship’s name in the table. All the photos in the table are also clickable.
Since ferries are of particular importance for Crimea, their names are highlighted in yellow.

A brief analysis of the black list
According to our information, as of July 10, 2015, 216 merchant vessels from 16 countries, including Russia and Ukraine, have made calls at the Crimean ports.
The Russian Federation heads the list of the violators: 101 ship or 46.75% of the total number of intruders.
Turkey takes the 2nd place: 52 vessels or 24.14% of the total number of intruders.
Greece is in the 3rd place: 28 vessels or 13.0% of intruders.
The vessels of these three countries – 181 total – account for 83.8% of the total number of intruders.
The corrections made on 13/07/15 are marked in red (see table).
Over the last 3 months, beginning with April 2015, the number of offenders has increased by 51 ship – from 165 to 216, mostly due to the vessels of the Russian Federation (30), Turkey (8) and Greece (5).
These three countries together account for the 84.3% increase in the number of the ships-violators.
That reflects a trend, when due both to the effect of international sanctions and the dissemination of information in the media about the constant monitoring of ship calls at the Crimean ports, foreign shipowners are less and less willing to deal with the Crimean contracts. So, they are more and more replaced by the vessels of the Russian ship owners.
It is important to note that of the 105 foreign vessels on the list (excluding Russian and Ukrainian ships), about a half (51) - committed violations in 2014, but have not repeated the offence afterwards.
36 of the 105 vessels are repeated offenders who have violated the regime both in 2014 and in 2015. 21 of them are Greek and Turkish - 6 and 15, respectively.
20 of the 105 ships have appeared on the "black list" only in 2015, 19 of them are Greek and Turkish - 6 and 13, respectively.
It should be notes that the entire increase in the number of the Greek ships offenders in 2015 was due to five large ferries for crossing the Kerch strait. A total of eight Greek ferries served the Kerch strait in 2014-15.
Three of the five ferries that called in Crimea in 2015, were sold to the Greek shipowners by Russian companies, while the other two - chartered with the change of flag and name.
Interestingly, one of the Greek ferries that was among the worst offenders in 2014-15 years - IONAS – on March 26, 2015, left the Kerch strait after the protests of the crew who had not been paid on time and were also worried about falling under the sanctions. The ferry was promptly transferred to the Baltic Sea.
No less interesting is that the official operator of the two new Greek ferries - AGIOS LAVRENTIOS, now just LAVRENTIOS, and MARIA ELENI, now just MARIA – is a company with a characteristic title "Oboronlogistika", while the capacity of each of the ferries is 500 passengers and 24 trucks. It’s natural to assume that it was picked to carry a military battalion with arms and equipment. Also, those ferries they depart not from the Port Kavkaz, but from a separate dock south of the port.
A similar situation is with the Turkish new ferry YENER C. It’s important to note that the provisions of the ferry line Port Kavkaz - Kerch Fishing Port officially includes freight trucks with hazardous cargo.
Russia now bulk purchases new Greek ferries, which has sidelined Turkish ferries in Crimea.
For instance, Turkish ferry HITACHI has been removed from the Samsun-Kerch line and transferred to the Samsun-Novorossiysk and Novorossiysk-Alexandria (Egypt) line.
The repeat offender YUSUF ZIYA ONIS (RAINBOW) that from the first days of occupation served the infamous Zonguldak - Sevastopol, Zonguldak-Yevpatoria and Feodosia-Novorossiysk lines, was first transferred to the Temryuk-Kerch merchant marine port and then sent to Varna for repair as part of the pre-sale preparation and change of name to AZOV.
Another veteran offender SEVASTOPOL (ULUSOY 2) that since the beginning of the annexation, had served the Novorossiysk-Feodosia and Novorossiysk-Kerch lines, after the introduction of the Greek ferries in June 2015, was transferred to the Novorossiysk- Zonguldak line.
The third Turkish "veteran" NOVOROSSIYSK (ULUSOY 1) that since June 2014, served the Novorossiysk - Novorossiysk and Feodosia – Kerch lines, has been sent for repair in Sevastopol and dropped from the Crimean ferry schedule.
Another general trend is the decrease in quality and capacity of the vessels that foreign shipowners sent to Crimea.
For example, of the 12 Turkish newcomers that have committed violations in 2015, eight vessels are over 30 years old, all are the river-sea type, six of which can be considered coasters, in other words, vessels limited to only a certain distance from the shore.
Finally, when analyzing the violators from such law-obedient EU and NATO states, as the United Kingdom (and the British Virgin Islands), Latvia, Bulgaria, Germany, Italy, we have found indirect indications that suggests that these shipowners who risk, despite the EU sanctions, to send their vessels to the annexed the Crimea are most likely, of Russian origin. That, however, does not give their impunity according to the EU legal regime towards Crimea.
And, finally, about Romania - a country that after the annexation of Crimea, has become a very strong ally of Ukraine.

2. Calls upon all States to desist and refrain from actions aimed at the partial or total disruption of the national unity and territorial integrity of Ukraine, including any attempts to modify Ukraine’s borders through the threat of use of force or other unlawful means;

5. Underscores that the referendum held in the Autonomous Republic of Crimea and the city of Sevastopol on 16 March 2014, having no validity, cannot form the basis for any alteration of the status of the Autonomous Republic of Crimea or of the city of Sevastopol;

Calls upon States, international organizations and specialized agencies not to recognize any alteration of the status of the Autonomous Republic of the Crimea and the city of Sevastopol on the basis of the above-mentioned referendum and to refrain from any action or dealing that might be interpreted as recognizing any such altered status”…
